Application Process
You must complete the initial
application process in order to utilize Internet Banking. This
involves completing an application at any of our locations or
completing a secure online application. Our Internet Banking
Department will verify the information you submitted for
accuracy and correct authorizations. In two (2) to three (3)
business days after the submission of your application, you will
be notified by mail of your Internet Banking User ID number and
temporary Password.
Log-On Security
Security is very important to
the Internet Banking system. At the time you request the
service, you will be issued a unique “User ID” and a temporary
“Password”. Upon your initial login, you will be prompted to
change the assigned temporary “Password” to an alpha-numeric one
of your choice that will then be used to gain access into the
system.
You should carefully select
an alpha-numeric password that is hard to guess. Because your
password is used to access your accounts, you should treat it as
you would any other sensitive personal data. Keep your password
safe. Memorize your password and never tell it to anyone. YOU
SHOULD CONSIDER CHANGING YOUR PASSWORD OCCASIONALLY, SUCH AS
EVERY NINETY (90) DAYS. THIS CAN BE DONE AT ANY TIME AFTER YOU
LOG ON FROM THE “OPTIONS” MENU.
To help prevent unauthorized access and ensure the security of
your accounts, we will end your online session if we have
detected no activity for ten (10) minutes. This is to
protect you in case you accidentally leave your computer
unattended after you have logged on. When you return to
your computer, you will prompted to re-enter your User ID and
Password in order to regain access into the system. To help
secure the authenticity of your assigned User ID, if at any time
it remains inactive during a duration of (90) ninety days it
will be determined dormant. This will result in the system
deleting your assigned User ID. You will then be required
to re-apply to receive a new User ID in order to utilize the
Internet Banking service. (Please refer to the BillPay
Service section below for scheduled payments).
Accounts
You will have the option to
tie any account of which you are a signer or owner to Internet
Banking. You will be able to utilize the service to initiate
payments or transfers from any of such tied accounts only if you
have the required withdrawal authority over the account to be
able to complete the transaction. By using Internet Banking, you
agree to maintain one or more accounts with us and to keep
sufficient balances in any account to cover any transactions and
fees that are ultimately approved by or related to the system.
If the accounts tied to Internet Banking are jointly held or
have multiple signers, you agree that access to the information
and all transactions initiated by the use of your User ID and
Password are authorized unless we have been notified to cancel
Internet Banking in accordance with the Termination section of
this Agreement.
Fees for Internet Banking
Internet Banking, including
balance inquiries, funds transfers and BillPay, is available to
our existing personal and commercial account customers at no
additional monthly charge; provided, however, that the fees and
service charges provided for in your deposit, line of credit,
loan, and other agreements with us, as described in our Schedule
of Fees and Charges, may also apply to services (such as stop
payment requests and check reorders) ordered online.
Balance Inquiries and
Funds Transfer Services
You may use Internet Banking
to check the balance of your accounts and to transfer funds
among your accounts. Transfers may be limited in amount as
provided in our agreements with you governing these services or
in accordance with our bank policies. In addition, your ability
to transfer funds between certain accounts is limited to Federal
law, as stated in your deposit agreements with us. For example,
you can make no more than six (6) electronic transfers from a
savings account during each statement period. Transfers made
using both Internet Banking and other transfer methods described
in your deposit agreements with us are counted against the
permissible number of transfers. We reserve the right to further
limit the frequency and dollar amount of transactions from your
accounts for security or credit reasons, as we may determine at
any time at our sole discretion. Please refer to the Definitions
section of this Agreement for account transfer cut-off times.
Balances shown in your
accounts may include deposits subject to verification by us. The
balance may also differ from your records due to deposits in
progress, outstanding checks or other withdrawals, payments or
charges. A transfer request may not result in immediate
availability because of the time required to process the
request. If you have further questions, contact your Internet
Banking Administrator at (800)580-0322 extension 2440 or
956-984-2433.
The balances are updated
periodically and the system will display the most current “as
of” date on the “accounts” summary page. There may be situations
that cause a delay in an update of your balances. The system
will use the most current balance available at the time of a
transaction to determine if a transaction may be approved.
BillPay
Service
It is easy to pay bills
online through our BillPay service, which is an electronic
payment system that permits you to initiate and authorize
certain payments from your accounts that are tied to the
Internet Banking system. The BillPay service will also allow you
to see a history of all the payments made from your accounts.
We are able to process
payments in United States Dollars to payees that have a US
Postal address. We allow you to set up your payees by choosing
from a large database of regional or national vendors (payees)
that we have prepared. Subject to our and the payee’s approval,
you will also be able to set up a payment to a payee that is not
in the database by entering the necessary information about the
payee; provided, however, that you agree not to use BillPay to
pay payees to whom you are obligated for tax payments, to settle
securities transactions or to make payments made pursuant to
court orders or fines.
You have the option of
setting up a payment to occur on demand (one-time) or on a
recurring frequency. Recurring payments are payments of a fixed
amount that are paid at a regular time interval, such as
monthly; on demand (one-time) payments are payments that vary in
amount and/or date. If you use the BillPay service to authorize
automated recurring payments, such payments must be for the same
amount each month, and they will be sent on the same calendar
day of each month or on the following business day if the
regular payment day does not fall on a business day. After you
have established an on demand payment or recurring payment, we
will automatically execute bill payments according to your
instructions until you have properly notified us, in accordance
with our procedures in effect at the time, of any cancellation
of your instructions. When you have entered and transmitted
payment instructions, you authorize us to withdraw funds from
your account accordingly.
The daily limit for the total
dollars of payments approved is governed by the system’s
available balance in the checking account selected for making
the payment. You can withdraw up to the system’s available
balance as long as your account shows sufficient funds to cover
your payments. (Refer to the Balance Inquiries and Funds
Transfer Services section of this Agreement for additional
information.) The payment will normally be charged to your
account on the business day that it is received and processed by
the payee.
Payments made with BillPay
utilize the Automated Clearing House (“ACH”) network, an
electronic funds transfer system organized by the United States
Treasury under Federal law and managed by the operating rules
and guidelines of the National Automated Clearing House
Association (NACHA). While the ACH network provides an
efficient method of clearing electronic payments, it is not an
instantaneous clearing method. Certain holds on funds occur
with respect to ACH network processing. Please contact your
Internet Banking Administrator if you have any questions
regarding the BillPay Service or the ACH network.
If for any reason a scheduled
payment processed through the system is declined, it will
automatically be rescheduled for the following business day. The
system will continue to attempt to pay the bill on the following
business days until there are sufficient funds or you cancel or
reschedule it.
Payments may be scheduled for
the current business day or any business day in the future. All
payments will be processed twice on each business day starting
at 12:00PM and again at 2:00AM. Anything scheduled on a
non-business day, or after the 2:00AM processing time, will not
be sent out until the following business day. Please be advised
that the payee may not process a payment on the business day
that it is received.
It is your responsibility
to authorize your bill payments in such a manner that your bills
are paid on time. When scheduling
payments, you should take into account delays that are inherent
in processing and sending bill payments. If the payee is to be
paid by paper check, you understand and agree that the check is
mailed to the payee and may not be received by the payee until
seven (7) to ten (10) business days or more. If the payee is to
be paid electronically, you understand and agree that the payee
may not receive the payment until three (3) to five (5) business
days or more. You understand and agree that further delays may
be caused by the failure of the payee to process a payment on
the business day that it is received. (Any delays caused by the
payee/vendor would result in additional days before the payment
would show on their records.) By using the BillPay service, you
authorize Lone Star National Bank and any third party processing
agent that we may select to use any payment method (electronic
or paper) we choose to process each of your payments. You are
responsible for any late payment or finance charge that may be
imposed as a result of your failure to schedule payments or
transmit payment instructions in a timely manner. Lone
Star National Bank will not be responsible for the disengagement
of your User ID due to system inactivity on your behalf.
You are required to activate your User ID within the (90) ninety
day period in which the User ID must be validated for all
prearranged or scheduled payments to remain valid for
processing. Failure to do so will result in the merchant
receiving non payment. (Refer to Log-On Security Section
above).
To cancel a bill payment that
you have scheduled, you must cancel the payment online the day
the payment was created or scheduled provided that the payment
is within the processing times noted above in this Agreement.
You may also contact our Internet Banking Department at (800)
580-0322 ext. 2440 or 2433.
The BillPay service is an
optional service for checking accounts. You must specifically
request to have this service removed.
Other Services
Through the Internet Banking system, you may submit a request to
stop a payment on a check you have written or on an electronic
draft that you have authorized, to reorder checks, to change
your address or to order certain documents. The system provides
you several means by which you can securely forward your request
for such services to us for processing. Generally, requests
received from the system will be processed within one (1)
business day using procedures that would handle similar requests
received by mail or fax. If urgent action is required, we
recommend that you contact Lone Star National Bank directly by
telephone or in person. There may be additional fees associated
with some of these services.
Additional terms of acceptance or disclosures may apply on the
Stop Payment service and these terms will be disclosed at the
time you complete the request. The Stop Payment service is
not available to cancel the payments scheduled through the
BillPay service.
Our Liability for Incomplete Transactions
We will process all bill
payments properly initiated through the Internet Banking system
in accordance with this Agreement; provided, however, that we
reserve the right to refuse to honor payment requests that
reasonably appear to us to be fraudulent. We will be responsible
for your actual losses if they were directly caused by our
failure to complete a bill payment or transfer to or from your
accounts on time or in the correct amount according to this
Agreement. However, there are some exceptions. We will not be
liable, for instance, if any of the following occurs:
1. Funds are not showing on the system’s
available balance in your account that is to pay for the bill or
transfer at the time of transaction.
2. Funds are subject to legal process or other
encumbrances restricting the payment or transfer.
3. You had knowledge of or questions about the
possible malfunction of the system when you initiated the
transaction.
4. Any information provided by you is incorrect
or incomplete or you did not follow our instructions for the
BillPay service.
5. There are any delays in the handling of the
payment by the payees.
6. Natural disasters (fire, flood, tornado,
etc.) or other uncontrollable circumstances (mail delays, power
failures, war, acts of terrorism etc.) prevented proper
completion and delivery of transactions.
7. Other applicable laws and/or regulations
exempt us from liability.
8. It can be shown that the merchant or payee
received the payment within the normal delivery timeframe and
failed to process the payment through no fault of Internet
Banking or our service providers, servicing agents and
contractors involved in the provision of Internet Banking.
9. It can be shown that the
delay was caused by unusual mailing delays by the US Post
Office.
Overdrafts; Order of Payments
It is your responsibility to
ensure that you have enough money or credit available in an
account from which you instruct Internet Banking or BillPay to
make a payment or transfer. If funds are withdrawn from any of
your accounts by means of electronic fund transfers, other than
through Internet Banking on same business day as an Internet
Banking transaction, and if such account contains insufficient
funds to enable both the electronic funds transfer and the
Internet Banking transfer to be made, the transfers will be made
in the order determined by us, in our sole discretion. You are
fully obligated to us to provide sufficient funds for any
payments or transfers you make or authorize to be made. If we
complete a payment or transfer that you make or authorize and we
subsequently learn that you have insufficient funds for the
transaction, you agree to reimburse us upon our demand, and you
further agree that we may reverse the transaction or offset the
shortage with funds from any other deposit accounts you have
with us to the extent permitted by the applicable law and the
terms of any other relevant agreements.
Unauthorized Transactions,
Errors and Questions
You are responsible for all transfers and bill payments you
authorize using Internet Banking services. If you permit other
persons to use your User ID and
Password, you
are responsible for any transactions they authorize from your
deposit and credit accounts.
If you discover that your
User ID and Password have been compromised, lost, stolen or used
without your authorization, notify us immediately.
Telephoning our Internet Banking Department at (800) 580-0322
extension 2440 or 2433 is the best way of limiting your possible
loss. If we are notified within two (2) business days after you
discover that your User ID and Password have been compromised,
lost or stolen, you can lose no more than $50 if someone used it
without your permission. If you do not notify us within two (2)
business days, and we can prove we could have prevented someone
from using the User ID and Password without your permission, you
could lose as much as $500 from each deposit account.
If your statement shows
unauthorized transactions or errors, or if you have questions
about a transaction on your statement, you must write us a
letter no later than sixty (60)
days after we sent you the first statement on which the
unauthorized transaction or error appeared. If you do not
tell us in writing about unauthorized transactions or errors
within sixty (60) days after such statement is mailed to you,
you may not get back any money that you lose after the sixty
(60) day period if we can prove that, if you had told us about
the unauthorized transactions or errors within such sixty (60)
day period, we could have stopped someone from taking the
money. If your User ID and Password
were involved in the unauthorized transaction that appears on
your statement, you may also be liable for the amounts set forth
in the preceding paragraph.
In your letter, which should
be addressed to Lone Star National Bank, Internet Banking
Department, P.O. Box 1127 Pharr, TX 78577, please give us the
following information:
1. Name
2. Account Number and User ID
3. Description of the error or what you are
unsure about, plus an explanation of why you believe it is an
error or why you need more information
4. The amount of the error
5. For a BillPay error also tell us:
·
Checking account number used to pay
the bill
·
Payee name
·
Date the payment was sent
·
Confirmation number
·
Payment amount
·
Payee account number for the
payment in question
Once we have received your letter, we will investigate the
information on your statement. If your account is a new account
(your account is considered a new account for the first thirty
(30) days after the first deposit is made, unless you already
had an established account with us before the account was
opened), we will tell you the results of our investigation
within twenty (20) business days after we hear from you in
writing; provided, however, that if we need more time, we may
take up to ninety (90) business days to investigate. If we
choose to take up to ninety (90) business days to investigate,
we will give you a provisional credit to your account within
twenty (20) business days. If your account is not a new
account, we will tell you the results of our investigation
within ten (10) business days after we hear from you in writing;
provided, however, that if we need more time we may take up to
forty-five (45) business days to investigate. If we choose to
take up to forty-five (45) business days to investigate, we will
give you a provisional credit to your account within ten (10)
business days. If we decide there was no error, we will furnish
you with a written explanation within three (3) business days
after the investigation is complete.
You do not have to pay any amount in question while we are
investigating, but you are still obligated to pay the parts of
your statement that are not in question. While we investigate
your amount in question, we cannot report you as delinquent or
take any action to collect the amount in question.

Parties

Internet Security
Information
Lone Star National Bank’s
Internet Banking system is part of the Jack Henry and Associates
Inc. Network that utilizes a comprehensive security strategy to
protect your accounts and transactions conducted over the
Internet. In-depth information on many of the techniques and
features employed by the system can be viewed or printed from
our website where the system’s consumer or commercial features
are explained under “Security.” In addition to our log-on
security, we use the SSL (secure socket layer) encryption
technology for everything you do in the Internet Banking system.
This technology is automatically activated by your browser when
it attempts to connect to our system and will support 128- bit
key lengths. Whenever SSL is securing your communications, the
browser will typically indicate the “secure session” by changing
the appearance of a small icon of a padlock at the bottom of the
screen from open to locked. What this means to you
is that your communications are scrambled from your browser to
our servers at all times so no unauthorized party can read the
information as it is carried over the Internet. In addition, our
servers have been certified by a “Certificate Authority” that
will assure you that you are actually talking to our servers
instead of someone pretending to be us. (If you are using an
older browser, such as anything prior to versions 6.0 on
Netscape or Internet Explorer, the “Certificate Authorities” key
may be expired and you may need to update it on your browser.
You can obtain instructions on how to do this by clicking on the
Test Browser icon located on the Internet Banking system login
page.)
During your use of the
Internet Banking system, we will pass a “cookie” to your browser
for identifying you during the session. We do not (and cannot)
use our cookies to obtain new information about you. A “cookie”
is security data that is given to a browser by a web server that
